How to File a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content appearing on this website infringes your copyright, you may submit a written DMCA notice including the following information.

Notification of Copyright Infringement

Pursuant to 17 U.S.C. § 512(c)(3), a valid copyright infringement notification must be a written communication (email is acceptable) that includes all of the following elements:

  • A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of the copyrighted work that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (such as the exact URL).
  • Information reasonably sufficient to permit us to contact the complaining party, including name, physical mailing address, telephone number, and email address.
  • A statement that the complaining party has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

What Happens Next

Once Proper Bona Fide Infringement Notification Is Received by the Designated Agent it is Company’s policy to do the following:

  1. Promptly remove or disable access to the allegedly infringing content
  2. Notify the individual who posted the content (if applicable)
  3. If necessary, investigate repeat violations and may restrict or block users who repeatedly violate copyright law

What Happens After a Proper Infringement Notification Is Received

Once a proper and complete copyright infringement notification is received by the designated agent, it is Sweet Magnoliaa’s policy to:

  • Promptly remove or disable access to the material that is alleged to be infringing.
  • Notify the content creator, contributor, or account holder responsible for the material (if applicable) that the content has been removed or access to it has been disabled.
  • Take appropriate actions as required by law, including but not limited to disabling repeat infringers, if applicable.
  • In some cases, allow the original poster to submit a counter-notification under Section 512(g)(3) of the DMCA if they believe the material was removed as a result of mistake or misidentification.

Sweet Magnoliaa reserves the right to remove any content alleged to be infringing without prior notice and at its sole discretion.

Please be aware that there are substantial legal penalties for false claims under the DMCA.

Counter Notification Procedures

If you believe that a copyright infringement notice has been wrongly filed against you, you may submit a counter-notification to the designated agent.

A valid counter-notification must be a written communication that includes the following:

  • A physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original infringement notification
